Adam Aderton Quoted in Regulatory Compliance Watch on SEC Confidentiality Agreements
Partner Adam Aderton was quoted in a Regulatory Compliance Watch article titled, “SEC Enforcement and Confidentiality,” which discussed the SEC Enforcement Division’s policy regarding confidentiality agreements and its recently updated Enforcement Manual. Discussing considerations when entering into confidentiality agreements, Adam explained the importance of trying to find out from SEC staff how they view a particular party in connection with their investigation. He noted that it is important to consider whether the SEC views the entity as a third party or a subject of the investigation, saying, “That distinction can be important in evaluating whether a confidentiality agreement is beneficial.”
