Partner Erica Rozow was featured on the Bloomberg Law Podcast, as well as quoted in articles by PlanAdviser and Pensions & Investments, regarding the Supreme Court’s oral arguments in Anderson v. Intel and the potential implications for plan sponsors and asset managers. On the Bloomberg Law Podcast, Erica discussed what potential impact a ruling could have on efforts to democratize access to private markets for retirement plans, noting that the movement has significant momentum and regardless of a ruling those efforts will continue. In discussing the Court’s consideration of how much guidance to provide lower courts evaluating challenges to 401(k) investment performance with PlanAdviser, Erica noted that “the focus of the arguments was on when, rather than if, the meaningful benchmark standard should apply.” In speaking to the impact of a final decision with Pensions & Investments, she noted that it could give plan fiduciaries “more confidence that they can effectively defend against a claim of imprudence, and also, defend against a meritless claim more easily.”
