Mike Garvey represents the Firm’s institutional clients in a wide range of high stakes commercial disputes and international arbitrations, including shareholder litigation, antitrust litigation, M&A litigation, cross-border litigation, insurance/reinsurance matters and internal investigations. Clients include KKR, L3Harris, AIG’s Board of Directors, Gardaworld, Tradeweb, Travelers, PAAMCO Prisma and Swiss Re. Mike is consistently recognized by The Legal 500 U.S. and has been recognized as a National “Litigation Star” by Euromoney’s Benchmark Litigation. He has an active pro bono practice, including advising the Natural Resources Defense Council and advocating for prisoners’ rights, and serves on the Board of Legal Services NYC.

  • Securing Kentucky Supreme Court win for client PAAMCO Prisma that dismissed for lack of constitutional standing claims purportedly seeking billions of dollars in damages on behalf of the state pension system. 
  • Obtaining dismissal with prejudice of high stakes class action antitrust suit against client Tradeweb.
  • Obtaining dismissal with prejudice of class action ERISA lawsuit against client L3Harris and successfully resolving related shareholder and regulatory claims.
  • Representing KKR in international arbitration and related cross-border litigation in connection with claims by KKR alleging fraudulent breach of representations and warranties.
  • Defending and advising AIG’s Board of Directors in a derivative action brought by the former CEO of AIG against the United States Government as well as in shareholder suits brought in the aftermath of the subprime crisis.
  • Representing the Special Committee of General Growth Properties in state and federal litigation arising from its $9.25 billion acquisition by Brookfield Property Partners.

Michael J. Garvey is a member of the Firm’s Litigation Department in the New York office. Mike is a general commercial litigator and experienced crisis manager who represents the Firm’s institutional clients in a wide range of high stakes, complex commercial matters.

His clients include KKR, L3Harris, the AIG Board of Directors, Gardaworld, Swiss Re, Tradeweb, PAAMCO Prisma, The International Swaps and Derivatives Association, Aquiline and Travelers. 

Mike has successfully defended Firm clients in a variety of large shareholder litigations and antitrust matters. Mike recently obtained from the Kentucky Supreme Court a decision dismissing claims against his client seeking billions of dollars in damages based on lack of constitutional standing. He also recently won early dismissal with prejudice of an antitrust class action suit against Tradeweb and an ERISA class action against L3Harris.

Mike has worked on the largest insurance and reinsurance coverage litigations in the last two decades. He is currently defending multiple insurers in policyholder lawsuits seeking coverage in connection with the COVID-19 pandemic. Among many other cases, he was on the team that successfully tried to a verdict Swiss Re’s claim against WTC leaseholder Larry Silverstein that the 9/11 terrorist attack was one occurrence under Silverstein’s $3.5 billion insurance policy.  

Mike continues to counsel the Firm's largest clients through numerous complex litigation-related crises. He handles large corporate and international arbitrations, overseas litigation, M&A litigation, complex bankruptcy matters and product liability work. He represents the Firm's Exempt Organizations and Personal Planning clients on litigation matters. Mike also has an active pro bono practice. He regularly represents the Natural Resource Defense Council and serves on the Board of Queens Legal Services, one of the largest providers of civil legal services to low-income people in the United States.

He is consistently recognized by The Legal 500 U.S. and Euromoney’s Benchmark Litigation as a National and New York “Litigation Star” in Insurance.

Mike joined Simpson Thacher in 1998, served as a law clerk to the Hon. Albert M. Rosenblatt, a judge on the New York State Court of Appeals, from 1999–2001, returned to the Firm in 2001 and became partner in 2007. He graduated cum laude from the State University of New York at Geneseo in 1995 with a dual degree in English and Music. He graduated cum laude from St. John’s University School of Law in 1998 where he served on Law Review.
