Linda Martin is a Partner in the Firm’s Litigation Department. She has extensive experience in large, complex commercial litigation and international arbitration, including in the areas of insurance and reinsurance, Lanham Act and false advertising disputes, bankruptcy-related litigation, securities, and general commercial matters.
Ms. Martin’s experience includes the successful representation of J.P. Morgan Chase in a breach of guarantee contract action against Motorola in which J.P. Morgan Chase obtained a $370 million verdict against Motorola following trial, and in various litigations arising out of the bankruptcy of Commercial Financial Services, Inc. Ms. Martin also represented Accenture (formerly Andersen Consulting) in connection with its successful bid to win a cost-free separation from the Andersen Worldwide organization in one of the largest ICC arbitrations in history. More recently, Ms. Martin has represented the Firm’s clients in arbitrations in London, Vancouver and New York. These include the successful representations of an insurance company client in a $370 million portfolio transfer/reinsurance dispute, and Korean conglomerate the Hanwha Group in a multi-billion dispute with the Korean government. In addition to her trial and arbitration work, Ms. Martin helped obtain reversal before the Second Circuit of an unfavorable summary judgment decision relating to the significant reinsurance doctrine of follow-the-fortunes. She also has represented various clients in connection with fraudulent conveyance and other bankruptcy-related matters, including successfully negotiating the resolution of a trading dispute arising from the downfall of Enron Corporation. In addition, Ms. Martin recently represented UBS AG as administrative agent for the term facility lenders in connection with the litigation aspects of recent debtor-in-possession financing for Lyondell Chemical Company. The facility, recognized as part of the largest DIP financing in history, contained several unique features and generated a variety of objections, but after several days of evidentiary hearings was approved virtually unchanged by the bankruptcy court.
Ms. Martin serves as a member of the Future Forum at Duke University School of Law, and is a member of the Board of Directors of The Children’s Tumor Foundation. Within the Firm, Ms. Martin serves on the Recruiting, Litigation Training, Technology, and Women’s Committees.
Ms. Martin received her B.A., cum laude, from Harvard University in 1988, and received her J.D., cum laude, from Duke University School of Law in 1996, where she was an editor for the Duke Law Journal. She is a member of the Association of the Bar of the City of New York, the New York State Bar Association, and the American Bar Association.
