Scott M. Kobak is a Partner in the Real Estate Department of the Firm. His main area of concentration has been in representing institutional investors in complex domestic and international commercial real estate acquisitions and developments, joint ventures and financings including active involvement with many of the most prominent real estate private equity funds. He acts as the main transaction counsel to Carlyle’s real estate fund, is actively engaged on a host of matters for Morgan Stanley’s global and domestic real estate funds (MSREF) and represents Blackstone on numerous transactions. Mr.
Kobak has recently represented several real estate private equity funds on their subscription line of credit and secured asset facilities that have included multiple facilities for Carlyle, Blackstone, MSREF, Soros, Cherokee and
J.E. Robert Company’s real estate funds. He also has had extensive experience representing both equity investors and lenders in structured finance
transactions, including leveraged and synthetic leases and has been involved in a host of major transactions in the hotel, office and retail sectors. Recent transactions completed by Mr. Kobak include Carlyle’s acquisition and financing of the Riverside South Project in New York City in a $1.76 billion transaction Carlyle’s investment in the 666 Fifth Avenue retail condominium in a
$700 million transaction and Carlyle’s acquisition and development of The Orion, Ariel East and West, Avery, Rushmore, and Georgica luxury condominium projects in New York City, Blackstone’s acquisition and financing of Extended Stay America, a publicly traded hotel company (including representing Blackstone on the then largest CMBS loan executed to date and multiple layers of mezzanine financing) and Blackstone’s disposition of several multi-billion dollar office portfolios acquired in the Equity Office transaction and MSREF’s multi-billion
dollar revolving credit facility for their latest global real estate fund. Mr. Kobak also is currently representing several of the above real
estate funds in major debt restructuring transactions related to the recent market turmoil.
Mr. Kobak joined Simpson Thacher & Bartlett LLP in 1993 after receiving his J.D. from Boston University Law School, magna cum laude, where he was an Associate Editor of the Boston University Law Review. He was
elected to become a member of the Firm in November 2000.
