Patent Litigation

The Intellectual Property Group handles complex patent infringement litigation in a wide variety of fields, including biotechnology, computer software, fiber optics, glass and plastic container manufacturing, integrated circuit design and fabrication, vision correction surgery, medical devices, microprocessors, optical circulators, videoconferencing equipment and wave division multiplexing technology products.

The group's attorneys are fluent in science and technology and work effectively with experts and witnesses to explain technical issues in pleadings and at trial. They also work seamlessly with other groups in the Firm, such as antitrust and bankruptcy, when combined expertise is required.  For example, the group successfully asserted an antitrust counterclaim and obtained a very favorable settlement for Nidek in recent patent infringement litigation brought by VISX over excimer laser refractive vision correction surgery. 

Among its current engagements, the group represents Daiichi Pharmaceutical in litigation over the multi-billion-dollar Levaquin® anti-infective drug.  It represents JDS Uniphase in a case involving fiber optic telecommunications components and Synchrologic in a matter involving data synchronization patents.  The group has also handled major patent litigations for Intel (defending the “bet the company” case brought by Digital Equipment Corp. over Pentium® microprocessor technology), Lotus Development (now part of IBM), NEC, Nobel Biocare (formerly Nobelpharma), Owens-Illinois, Polaroid, United Microelectronics and USA-Kaifa Technology.
