Licensing Disputes

The Intellectual Property Group frequently represents clients in disputes over licenses and other agreements relating to intellectual property rights.  The group combines trial skills with hands-on transactional expertise to provide a unique approach to handling this type of dispute.

For example, the group currently represents Polo Ralph Lauren in a $550 million litigation against Jones Apparel over the termination of licenses to use the LAUREN® trademark; the Apollo Theater Foundation in a dispute with a former licensee concerning library episodes of the television series “It’s Showtime at the Apollo”; and a Dow Jones-Reuters joint venture in the industry-wide litigation concerning the scope of electronic rights contained in licenses granted by freelance writers.  The group represented the Hard Rock Hotel in an action concerning its rights under a website license granted by Hard Rock Café, and Owens-Illinois in an adversary proceeding seeking to enforce the non-assignment provisions of a technology license.  The group has also represented notable clients in the semiconductor and biotechnology industries in a number of important confidential arbitrations.

When appropriate, the group tries to resolve licensing disputes before litigation is commenced.  Members of the group work closely with clients to negotiate practical business solutions and to prevent the waste of resources in needless litigation.  The group has negotiated numerous licenses and consent agreements in this context.
