Litigation Partner Buzz Frahn and Litigation Associates Jenny Palmer and Tomi Mendel co-wrote an article published on the California Lawyers Association’s website. The article, titled “Ninth Circuit Affirms Rejection of Caddies' Antitrust Claims Against PGA Tour - But Grants a Mulligan,” discusses a recent Ninth Circuit decision affirming the district court’s dismissal of golf caddies’ Sherman Act claims. The caddies had challenged the PGA Tour’s requirement that they wear ads with printed advertisements during tournaments, arguing that the requirement violated antitrust law by inhibiting the caddies from featuring their own sponsors. In addition, the caddies argued that the practice artificially restricted the supply of advertisements. The Northern District of California dismissed these claims and the Ninth Circuit affirmed the dismissal. However, the Ninth Circuit vacated the dismissal with prejudice, thereby giving the caddies the opportunity to refine their proposed market definition and revive their claims.
