Simpson Thacher Attorneys Author Article on Recent Insurance Case Law Concerning Policy Periods
Partner Joshua Polster and Associate Theodore Gruer authored an article titled, “No Coverage in Perpetuity: Rejecting Emotional Distress as a Trigger for Post-Abuse Policy Periods,” which was published by New York Law Journal. The article explored a recent reversal by the Georgia Court of Appeals, which found that mental anguish from prior abuse did not constitute a new injury “occurring” in subsequent policy periods. The article further analyzed this recent development within the context of several decisions across the country that have considered a similar issue, as well as within the larger body of insurance case law on trigger.
