On June 2, 2026, the SEC published a Draft Strategic Plan for fiscal years 2026 through 2030, signaling a significant shift in the SEC’s regulatory philosophy under SEC Chair Atkins. SEC Chair Atkins has characterized the plan as a return to the agency’s core mission of protecting investors, maintaining fair and efficient markets, and facilitating capital formation—a deliberate departure from the prior administration’s emphasis on expanding regulatory reach through new disclosure mandates and proactive enforcement.
The Draft Strategic Plan sets forth three principal goals. First, it seeks to renew the SEC’s regulatory policy focus to support innovation, capital formation, market efficiency, and investor protection by promoting “clear, fit-for-purpose rules that foster responsible innovation and deter misconduct.” A notable objective under this goal is establishing a coherent regulatory foundation for digital assets and distributed ledger technologies.
Second, the Plan aims to recalibrate the SEC’s regulatory practices to emphasize greater stakeholder engagement and to return enforcement to Congress’s original intent. Under this approach, the SEC would focus on policing violations of established law, such as fraud and market manipulation, rather than expanding its regulatory reach through ad hoc enforcement actions. Enforcement success would be measured by deterrence and enhanced market clarity, rather than by case volume or the amount of monetary penalties imposed. This goal also contemplates periodic retrospective reviews of existing rules, including those governing private fund reporting.
The third goal is to optimize operational efficiency through technology modernization, including overhauling EDGAR and responsibly integrating AI, and reforming employee performance management.
Public comments on the Plan were due on July 2, 2026.
