Simpson Thacher Attorneys Author Article on Private Credit Restructurings
Partners Stephanie Marshak and Jack Luze authored an article titled, “A Decision Framework for Private Credit Restructurings,” which was published by the New York Law Journal. The article discussed restructuring options for distressed private credit investments as defaults rise and maturities approach. It further analyzed the benefits, risks and practical considerations associated with a range of out-of-court and in-court solutions, including debt-for-equity exchanges, strict foreclosures, UCC sales, assignments for the benefit of creditors and chapter 11 proceedings.
