Partner Meaghan Kelly was quoted in a Private Equity Law Report article titled, “SEC 2025 Examination Priorities Feature Essential Compliance Concerns, Emerging Technologies and Several Notable Omissions.” In discussing the SEC Division of Examinations’ focus on emerging technologies, Meaghan noted that it is interesting that the focus on AI in the Annual Priorities has expanded from the initial focus on the investment process itself to advisory operations, including compliance. She said, “It is almost an explicit market-facing broadening in the SEC's focus that gives compliance officers a heads up that any AI use cases at the adviser level will be scrutinized during an exam.” When discussing some areas that were omitted from the priorities this year, such as certain whistleblower provisions and broader mentions of the Marketing Rule, Meaghan indicated that the Annual Priorities are much shorter than in 2024, but they are not intended to be an exhaustive list or the only "guiding star" for CCOs.
