Solicitor General and the Federal Trade Commission Support Weyerhaeuser’s Petition for a Writ of Certiorari

Simpson Thacher achieved a critical step in its representation of Weyerhaeuser in a number of related antitrust actions when the United States filed an amicus brief urging the Supreme Court to grant Weyerhaeuser’s petition for certiorari and reverse the Ninth Circuit’s affirmance of a jury verdict that Weyerhaeuser unlawfully monopolized the market for alder sawlogs. The Solicitor General, the Department of Justice and the Federal Trade Commission agreed with the legal position the firm has argued since being retained in the aftermath of the initial adverse jury verdict in the case, as well as in several follow-on cases. The firm’s efforts also resulted in seven separate amici briefs being filed on behalf of a diverse list of companies and associations, including Microsoft, Apple, Coca-Cola, BellSouth, SBC, Verizon, Dow Chemical, Caterpillar, Black & Decker, the Chamber of Commerce of the Unites States, The American Forest and Paper Association, The Business Roundtable, and The National Association of Manufacturers.
