Simpson Thacher antitrust partner Kevin Arquit is co-editor (with Jacques Buhart of Herbert Smith LLP) of a new book entitled Leniency Regimes. This important work addresses a relatively recent development in the context of global competition and antitrust law: enterprises that "self-report" non-competitive practices to regulatory authorities in "leniency regimes" may receive lesser penalties than those involved in investigations initiated by those same regulatory authorities. The self-reporting process, however, must be approached with caution and should be guided by careful and experienced legal counsel.
This book collects guidance on this topic from some of the world's leading law firms under the editorship of two outstanding antitrust practitioners and includes a country-by-country guide to general counsel considering leniency and referring practitioners.
