Josh Polster Quoted in Law360 on Outlook for Insurance ESG Claims
Partner Josh Polster was quoted in a Law360 article titled, “Insurance Remains Steadfast Amid ESG Regs, Litigation,” which explored insurance-related issues that may arise for ESG claims. Josh explained that corporate policies can run into coverage issues like the prior knowledge exclusion or a fortuity requirement, noting “The nature of some of these ESG claims — they may not actually be alleging an accidental loss, but more like challenging intentional corporate policy, and there may not be coverage for that sort of thing.”
