Rafi Prober and Karen Christian Quoted in Law360 on Congressional Investigations Following the 2026 Midterm Elections

Rafi Prober and Karen Christian, Co-Heads of the Firm’s Congressional Investigations Practice, were quoted in a Law360 article titled, “5 Midyear White Collar Trends To Watch,” discussing the potential increase in congressional investigations if Democrats make gains during the 2026 midterm elections. Karen said Democrats in Congress have shown a "sense of frustration around policy decisions, rollbacks or regulatory decisions that they think weren't the correct path," especially with regard to energy and healthcare. "We're seeing a big uptick in clients proactively thinking through the potential risk areas and how to get ahead of that," added Rafi.

Rafi noted that congressional investigations move quickly so "one of the biggest commodities in these investigations is time, and being able to prepare, plan and come up with a strategy." Karen also suggested the possibility of parallel investigations with state attorneys’ general. "A lot of AGs testify to Congress now on investigations and regulatory landscape, not strictly on bread-and-butter law enforcement stuff," she said. "You know the information is going back and forth, you can just sense it. I would expect that kind of information flow to continue.”
