Rafi Prober and Karen Christian Quoted in Law.com on Navigating Congressional Investigations
Partners Rafi Prober and Karen Christian, Co-Heads of Simpson Thacher’s Congressional Investigations Practice, were quoted in an article titled, “In a Congressional Investigation, ‘You’re an Exhibit in Their Story,’” which was published by Law.com. The article discusses how congressional investigations differ from traditional litigation and the unique considerations involved in preparing witnesses to appear before Congress. Rafi explained, “The things that you might traditionally rely upon and have comfort in in a civil litigation don’t exist in Congress,” and noted that preparing a witness requires thinking through issues that “might seem far afield from the topic of the hearing.” Karen emphasized the unique dynamics of congressional investigations, explaining, “The committee is judge, jury, prosecutor, all in one,” and adding, “You’re an exhibit in their story.”
