Simpson Thacher associate Fernando Szterling published an article entitled Collateralization of OTC Derivatives: Negotiating an ISDA New York Law Credit Support Annex, in the January 12, 2009 issue of Asset Securitization Report – ASR. The article focuses on the ISDA New York Law Credit Support Annex, the most common collateral agreement in over-the-counter derivatives. Issues analyzed include calculations for posting and returning collateral, dispute resolution mechanisms, designation of the Valuation Agent and transparency of its calculations, and the choice between bilateral and unilateral arrangements.
