New Forum for Objections Emerges
Simpson Thacher Los Angeles litigation partner Mike Kibler and Los Angeles litigation associate Michael Freedman co-authored an article entitled “New Forum for Objections Emerges” that was published in the February 21, 2011 issue of The Recorder. The article addresses the Ninth Circuit’s recent decision in In re Oracle Corp. Securities Litig. and recent amendments to the Federal Rules regarding evidentiary challenges at the summary judgment stage. Using California state court practice as a point of reference, the article addresses the increasing importance of developing evidentiary foundations early in a case. Lastly, the article addresses how attorneys facing similar issues as in Oracle might approach those issues to achieve a different outcome.
