The Confluence of European Activism and American Minimalism: “Patentable Subject Matter” After Bilski

Simpson Thacher litigation partner Patrick King, litigation associate Ryan Roberts and former summer associate Andrew Moshirnia co-authored the article “The Confluence of European Activism and American Minimalism: ‘Patentable Subject Matter’ After Bilski” published in the March 2011 Santa Clara Computer & High Technology Law Journal.  The article compares the explicit European judicial reshaping of a flexible patentability standard to the Supreme Court’s implicit tailoring in its recent decision Bilski v.
