California Lawyers Association Publishes Simpson Thacher Antitrust Article

Litigation Partner Buzz Frahn and Litigation Associate Steven McLellan co-wrote an article published on the California Lawyers Association's website. The article, “In re Solodyn Pay-for-Delay Suit Heads Toward Trial After District of Massachusetts Denies Motion for Summary Judgment,” discusses the In re Solodyn Antitrust Litigation summary judgment motions from both sides that were denied by Judge Denise J. Casper in January 2018. The antitrust lawsuit stemmed from a reverse payment settlement in a patent case between Defendants Medicis Pharmaceutical Corporation and Impax Laboratories, Inc. Defendants argued that the plaintiffs lacked market power and thus did not carry their burden under Sherman Act Section 1 rule-of-reason analysis; while the plaintiffs, consisting of direct purchasers, end-payors and major retailers, argued that Medicis had market power.
