Simpson Thacher Authors Article on Courts Permitting AI Expert Analysis Without Expert Witnesses

Litigation Partner Laura Lin authored an article titled, “AI on the Stand: Do We Still Need the Expert Witness?” which was published by the Daily Journal. The article discussed a proposed new rule from the Advisory Committee on Evidence Rules that would let courts consider AI expert analysis without an accompanying human witness. The article also outlined various scenarios in which a human expert is needed to accompany AI analysis in order to help guide the jury’s understanding of the evidence or expert “opinion” that the AI has presented. Summer Associate Brad Lewinski provided valuable assistance with this article.
