Simpson Thacher Attorneys Author Article on Short Seller Reports in Securities Class Actions
Global Co-Chair of the Firm’s Litigation Department Jonathan Youngwood and Senior Counsel Janet Gochman authored an article titled, “Short Sellers and Securities Suits: What Companies Need to Know,” which was published by New York Law Journal. The article detailed how many of the federal securities class actions filed in the United States in 2025 arose out of allegations in short seller reports. It further provided an overview of securities class actions, the impact of short sellers on security suits and defenses to short seller reports, including challenging loss causation and challenging confidential witness statements.
