Laura Brett Co-Authors Article on the Importance of Confidentiality in NAD Proceedings
Laura Brett, leader of the Firm's Advertising Advisory and Litigation Practice, co-authored an article titled, “Why Confidentiality Matters: Extending Mediation Privilege to NAD Proceedings,” which was published by the American Bar Association Antitrust Law Section. The article examined the role of confidentiality in proceedings before the BBB National Programs National Advertising Division (NAD) and how courts should protect advocacy, arguments and materials prepared specifically for NAD proceedings from discovery in subsequent litigation. The piece further noted that preserving confidentiality helps maintain the integrity and effectiveness of the self-regulatory process, reinforces consumer trust in advertising and promotes fair competition.
