Simpson Thacher Wins $11 Million Jury Verdict in Second IOENGINE Patent Case

On February 17, 2017, after a five-day trial in the District of Delaware before Judge Gregory M. Sleet, the jury returned a verdict in favor of the Firm’s client, IOENGINE, LLC (“IOENGINE”), on its claims of patent infringement. The case involved secure USB storage devices sold by Imation Corp. (“Imation”) under the “IronKey” brand. The jury found all 11 asserted claims of IOENGINE’s patent both valid and infringed by 25 of Imation's IronKey product lines, and awarded $11 million in damages for past infringement from September 17, 2013 to January 31, 2016. The jury rejected all of Imation’s challenges to the patent and credited IOENGINE’s founder as the sole inventor of the patented technology.
The verdict marks the second jury verdict for IOENGINE against an infringer in as many months. On January 13, 2017 a previous Delaware jury found the same patent both valid and infringed by “Defender” secure USB storage devices sold by Interactive Media Corp. d/b/a Kanguru Solutions.
