Simpson Thacher Wins Federal Circuit Patent Appeal on Behalf of CSR
On March 2, the Federal Circuit affirmed the invalidity determination of the Patent Trial and Appeal Board relating to a patent owned by Skullcandy Inc. The patent purported to cover a set of headphones for mobile devices that allow the audio from a telephone call to interrupt the music that a user is listening to. This was the second victory for Simpson Thacher at the Federal Circuit relating to this dispute, having succeeded in April 2015, in that case asking the Federal Circuit to reverse the prior determination of the PTAB.
