Sandy Qusba Quoted in Bloomberg on LME and Restructuring Documentation Trends

Sandy Qusba, Head of the Firm’s Restructuring Practice, was quoted in a “One Question” feature in Bloomberg’s The Brink newsletter discussing documentation trends in liability management exercises and restructurings. While sponsors and borrowers are trying to introduce anti-cooperation agreement language, he explained, “If you have a lot of demand on a new transaction, you're going to have people who accept the term.” He further discussed how anti-cooperation agreement language may take a variety of forms, including claiming it is invalid to have any agreements outside of the credit agreement, restricting transfers by modifying the assignment provisions to limit the ability to assign to co-op lenders and limiting voting rights to people who are in the co-ops.
