Simpson Thacher obtained dismissal of a securities complaint filed in the Middle District of Tennessee against Dollar General and certain of its current and former officers. The complaint asserted that the defendants violated Sections 10(b), 20(a) and 20A of the Securities Exchange Act and Rule 10b-5 by making allegedly false and misleading statements over a four-year period regarding the Company’s inventory and staffing management, pricing practices, and accounting metrics. On June 24, 2025, Judge Aleta Trauger dismissed the complaint without prejudice because it did not allege facts that give rise to a strong inference of scienter.
The Simpson Thacher team included Peter Kazanoff, David Elbaum, Amy Dawson, Ev Gilbert, Nicholas Cunha and Justin Kane.
