Ken Burdon Featured on “NAVigator Podcast with host Chuck Jaffe” Discussing the Supreme Court’s Decision Restricting Private Claims Against Investment Funds
Registered Funds Partner Ken Burdon joined an episode of the “NAVigator Podcast with host Chuck Jaffe” to discuss the recent U.S. Supreme Court ruling in FS Credit Opps. Corp. v. Saba Capital Master Fund, which found private investors do not have a private right of action to bring lawsuits challenging contracts that they allege violate the Investment Company Act. On the podcast, Ken said the decision eliminates a key avenue under the Investment Company Act of 1940 that activists have used to challenge fund fees and structure. He goes on to discuss how the ruling may encourage the issuance of more closed-end funds going forward.
