Stephen Blake Authors Article in The Recorder on ESG-Related Shareholder Litigation and Regulatory Enforcement Landscape

Litigation Partner Stephen Blake authored an article titled, “Taking Stock of Recent ESG Regulatory and Shareholder Litigation Developments,” which was published by The Recorder. The article explores the increasing interest in ESG initiatives from investors and securities regulators and the resulting litigation environment, including developing disclosure rules and recent enforcement activities in the space. It further highlights the increasing number of securities lawsuits related to ESG issues as well as the upward trend of derivative lawsuits alleging that corporate directors have breached their fiduciary duties. The article also analyzes an adverse reaction to the growing prominence of ESG initiatives, including over a dozen state legislatures passing laws prohibiting state entities from conducting business with entities advancing certain ESG initiatives or from considering ESG in investment decisions.
