09.01.26

Partners Mark Skerry and Mick Tuesley, and Associate Noah Sissoko, authored an article titled, “Using CFIUS' New Risk Matrix And Mitigation Guidance,” which was published in Law360. The article examines the U.S. Department of the Treasury’s newly issued CFIUS Risk Matrix, which outlines eight common categories of national security risks reviewed by the Committee on Foreign Investment in the United States (“CFIUS”) and provides guidance on corresponding mitigation measures. The authors discuss how the matrix offers greater transparency into CFIUS’s approach to evaluating national security risks and explores the practical implications of the guidance for dealmakers, emphasizing how the new resources can help parties identify and address national security considerations earlier in the transaction process.
