Partner Mark Skerry and Associate Alexis Capati authored an article titled, “FDI in the Trust Economy: Examining the CFIUS Known Investor Program and Other FDI Fast-Track Programs Around the World,” which was published in CPI Antitrust Chronicle’s National Security edition. The article examines how foreign direct investment (FDI) regulators around the world are introducing streamlined review mechanisms for low-risk investors as filing volumes continue to rise, with a particular focus on the Committee on Foreign Investment in the United States’ (CFIUS) proposed Known Investor Program. The authors analyze a range of emerging approaches, including investor-specific pre-clearance programs, country-of-origin-based exemptions and adversary-focused screening models across jurisdictions including the United States, Australia, Canada, the European Union, India, Japan and New Zealand.
