Simpson Thacher Secures Dismissal with Prejudice in Antitrust Class Action

On January 8, 2026, Simpson Thacher won dismissal of all claims against client Covestro AG in the Western District of Pennsylvania in a multidistrict antitrust class action. The suit, brought by direct purchasers, alleged a conspiracy among chemical manufacturers to fix prices of methylene diphenyl diisocyanate (MDI) and toluene diisocyanate (TDI), key components in polyurethane products.

U.S. District Judge W. Scott Hardy granted Covestro AG’s motion to dismiss for lack of personal jurisdiction, finding that the Court lacked the necessary jurisdiction over the German-based company. The Court dismissed all claims against Covestro AG with prejudice and terminated the company as a party to the litigation. Covestro LLC, a U.S.-based entity, remains a party to the litigation.
