Document Production in International Arbitration – How Much is Too Much? Observations from a Common-Law Perspective

Simpson Thacher partner Tyler B. Robinson’s article entitled, “Document Production in International Arbitration – How Much is Too Much?  Observations from a Common-Law Perspective” was published in the Swiss Arbitration Association’s Special Bulletin on “The Search for ‘Truth’ in Arbitration”.  The article topic was originally presented at the ASA’s Annual Conference in Zurich, Switzerland in February 2009, and presents some common-law perspectives on the advantages of being able to obtain in international arbitration documents in the possession of another party that the other party may not choose to disclose in support of its own case, a subject of considerable controversy and debate among arbitration practitioners from diverse legal cultural backgrounds.  The ASA Special Bulletin is available for purchase at: http://www.jurispub.com/cart.php?m=product_detail&p=10519.
