Corporate Litigation: Dodd-Frank and Whistleblower Protection: Who Qualifies?
In his column on Corporate Litigation published in the New York Law Journal, Joseph M. McLaughlin reviews the recent decision in Asadi v. GE Energy (USA), in which the Fifth Circuit limited Dodd-Frank's whistleblower protection to individuals who report to the SEC, rejecting several district court decisions (including recent Southern District of New York authority) and the view embodied in the SEC's implementing regulation extending protection to employees who report internally.
