Simpson Thacher Partners Author Article on the GENIUS Act’s Regulatory Framework for Stablecoins

Partners Brian Christiansen, Spencer Sloan and Amanda Allexon, and Associate James Fine, authored an article titled, “GENIUS Act Establishes Regulatory Framework for Stablecoins,” which was published by Thomson Reuters Westlaw. The article discussed the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act, which was recently signed into law and establishes a regulatory framework for the issuance of stablecoins backed by U.S. dollars, short-term U.S. Treasuries and certain other enumerated assets. The article detailed key provisions of the Act, including its use of the term “payment stablecoin,” reserve and custody requirements for payment stablecoins, permitted payment stablecoin issuers (PPSIs), the federal regulatory framework for PPSIs, examination and enforcement provisions, alternative state-based framework and effective date and implementation, as well as digital asset and banking industry reactions.
