Simpson Thacher Attorneys Author Article on DOJ Corporate Enforcement Policy

Partners Martin Bell, Nicholas Goldin, Jeffrey Knox and Karen Porter authored an article titled, “DOJ’s Department-Wide Corporate Enforcement Policy,” which was published by Thomson Reuters Westlaw. The article examined the U.S. Department of Justice’s (“DOJ”) new corporate enforcement policy (“CEP”) and the potential benefits for companies that voluntarily report misconduct. It further detailed how the DOJ will decline to prosecute if four factors are met under the CEP, how the CEP provides meaningful incentives to companies with “near miss” disclosures and other resolutions. It also explored the nationwide application of the CEP and compliance considerations for companies.
