Amy Candido, Head of Simpson Thacher’s Intellectual Property Litigation Practice, authored an article titled, “Model Jury Instructions Provide Next Step In Aligning DTSA,” which was published by Law360. The article examined new model jury instructions for the Defend Trade Secrets Act (DTSA) – the first comprehensive set of instructions for the statute – that were developed by The Sedona Conference’s Working Group 12 on Trade Secret Law and published on the statute’s ten-year anniversary. As one of the senior editors who developed the DTSA Model Jury Instructions, Amy outlined in the article key trial management challenges under the DTSA, noteworthy takeaways from the new Model Instructions and how these instructions represent a significant step toward harmonizing DTSA trial practice going forward.
