Matt Kelly and Kim Le Quoted in Law360 on the Evolving AI Regulatory Landscape
Matt Kelly, Head of Simpson Thacher’s AI Practice, and Kim Le, head of the West Coast privacy and cybersecurity team, were quoted in a Law360 article titled, “Data Privacy & AI Issues To Watch For The Rest Of 2026,” on the current U.S. AI regulatory landscape at the federal and state levels. Matt said companies are prioritizing AI deployment while seeking to minimize risk. "However, there's still a high level of volatility on the regulatory side. We find it is better for companies to focus on making meaningful, good-faith efforts to manage their operational risk rather than having draft regulations drive compliance," he said. Kim added that "the delta between" what's said on paper and what's done in practice is where litigation and enforcement "tends to reside" from not only the FTC but also state regulators that are expected to remain highly active in this space.
